Welcome to JHX Hoops LLC (“JHX Hoops,” “we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your access to and use of our website, services, programs, merchandise store, events, and other offerings (collectively, the “Services”). By using our Services, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, please do not use our Services.

1. Use of Services

You must be at least 13 years old to use our Services. If you are under 18, you may only use our Services with the involvement of a parent or legal guardian.

You agree to use the Services only for lawful purposes and in accordance with these Terms. You are responsible for all activity that occurs under your account.

You agree not to:

Use the Services for any fraudulent or harmful purpose
Impersonate any person or entity or misrepresent your affiliation
Interfere with or disrupt the operation of the Services
Attempt to gain unauthorized access to any systems or networks

2. Account Registration

To register for camps, tournaments, or to make purchases, you may be required to create an account. You agree to provide accurate and complete information, and to keep that information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. Payments and Refunds

All prices for events, products, and services are displayed in U.S. dollars. Payment is due at the time of registration or purchase. We accept major credit and debit cards via our secure third-party payment processor.

Refund Policy:

Event registrations are refundable (minus a processing fee) up to 2 days prior to the event.
Merchandise sales are final unless the item arrives damaged or incorrect.

Please review specific terms at the time of registration or purchase.

4. Athletic Participation Disclaimer

Participation in athletic activities, including but not limited to basketball camps, leagues, clinics, and tournaments, involves inherent risks, including the risk of serious injury or death. By registering for and participating in such activities, you (or your parent/guardian, if under 18) acknowledge and voluntarily assume all risks associated with physical activity. You agree to release and hold harmless JHX Hoops LLC, its staff, coaches, volunteers, and affiliates from any and all claims, liabilities, or damages arising out of your participation in athletic programs.

5. Waiver for Minors

If you are registering a participant under the age of 18, you affirm that you are the legal parent or guardian and that you consent to the minor’s participation in JHX Hoops programs. You agree, on behalf of the minor and yourself, to waive any and all claims against JHX Hoops LLC arising from participation in Services and to indemnify and hold harmless the organization for any resulting liabilities or expenses.

6. Media Release

By participating in JHX Hoops events or services, you (or your parent/guardian, if under 18) grant permission for JHX Hoops LLC to use any photographs, video, or audio recordings taken during events for promotional, educational, or informational purposes in any medium, including social media and our website. If you wish to opt out of media use, you must notify us in writing at info@jhxhoops.com prior to the event.

7. Intellectual Property

All content included in the Services—including logos, text, graphics, photos, videos, and software—is owned by or licensed to JHX Hoops and is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, modify, distribute, or otherwise use any content from our Services without our express written permission.

8. User Content

You may submit content such as photos, videos, feedback, or testimonials (“User Content”). You retain ownership of your User Content, but by submitting it, you grant JHX Hoops a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute it in connection with our Services and marketing.

You represent that you own or have the necessary rights to grant this license.

9. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE DO NOT MAKE ANY WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not guarantee that the Services will be error-free or uninterrupted, or that defects will be corrected.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, JHX HOOPS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS OR (B) $100.

11. Indemnification

You agree to indemnify and hold harmless JHX Hoops and its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, and expenses arising from your use of the Services or your violation of these Terms.

12. Third-Party Links

Our Services may contain links to third-party websites. We do not control or endorse these websites and are not responsible for their content or practices. Your use of third-party sites is at your own risk.

13. VoIP and SMS Communications

We may use Voice over Internet Protocol (VoIP) and SMS services to communicate with users regarding registrations, events, and promotional campaigns. By providing your mobile number, you consent to receive automated or non-automated communications from JHX Hoops LLC. Message and data rates may apply.

Opt-In and Opt-Out Instructions: You may opt in to receive SMS messages by subscribing through our registration or communications forms. To opt out at any time, reply “STOP” to any message you receive or contact us directly at info@jhxhoops.com.

Privacy Disclosure: We do not share, sell, or rent mobile information with third parties for marketing purposes. All mobile information shared with us will remain confidential and used only in accordance with our Privacy Policy.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Kansas, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the Services shall be resolved exclusively in the state or federal courts located in Douglas county, Kansas

15. SPECIAL INFORMATION FOR CALIFORNIA RESIDENTS

California residents may request a list of certain third parties to which we have disclosed personally identifiable information about you for their own direct marketing purposes. You may make one request per calendar year. In your request, please attest to the fact that you are a California resident and provide a current California address for your response. You may request this information in writing by emailing us at info@jhxhoops.com. Please allow up to thirty (30) days for a response.

16. Changes to These Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website with a new “Effective Date.” Continued use of the Services after such changes constitutes your acceptance of the revised Terms.
